Arizona DUI Laws

**Arizona DUI laws are constantly being amended which means the following penalties may not be applicable in your case. The following is a brief overview of current Arizona DUI laws.

First Offense DUI (Non-Extreme) BAC < .150

Jail Time: Minimum 10 days in jail with the possibility of 9 days being suspended if you complete a drug/alcohol assessment.

Fines & Costs: Minimum $250 fine plus 80% surcharge, $500 prison assessment fee, $500 DPS fee, jail costs, treatment costs, and probation fees (you may be placed on probation up to 5 years).

License Implications: 90 day suspension of your driving privileges, but you may be eligible for a work/school permit after the first 30 days of the suspension.

Ignition Interlock Device: Yes. For 1 year.

Other Possible Penalties: You may be ordered to perform community service and attend a Mothers Against Drunk Driving Victims Impact Panel.

First Offense Extreme DUI (BAC .150 – .199)

Jail Time: You must serve a mandatory 30 days in jail with no days suspended.

Work Release: You may be eligible to be released for work up to 5 days per week at no more than 12 hours per day.

Fines & Costs: Minimum $250 fine plus 80% surcharge, $1,000 prison assessment fee, $1,000 DPS fee, $250 abatement fee, jail costs, treatment costs, probation fees (you may be placed on probation up to 5 years).

License Implications: 90 day suspension of your driving privileges, but you may be eligible for a work/school permit after the first 30 days of the suspension.

Ignition Interlock Device: Yes. For 1 year after your license is reinstated.

Other Possible Penalties: You may be ordered to attend a Mothers Against Drunk Driving Victims Impact Panel and perform community service.

First Offense “Super Extreme” DUI (BAC .200 or higher)

Jail Time: You must serve a minimum of 45 days in jail.

Work Release: You may be eligible to be released for work up to 5 days per week at no more than 12 hours per day.

Fines & Costs: Minimum $500 fine plus 80% surcharge, $1,250 prison assessment fee, $1,250 DPS fee, $250 abatement fee, jail costs, treatment costs, probation fees (you may be placed on probation up to 5 years).

License Implications: 90 day suspension of your driving privileges, but you may be eligible for a work/school permit after the first 30 days of the suspension.

Ignition Interlock Device: Yes. For 18 months after your license is reinstated

Community Service: The court must impose a minimum of 30 hours of community service.

Other Possible Penalties: You may be ordered to attend a Mothers Against Drunk Driving Victims Impact Panel.

Second Offense DUI (Non-Extreme) BAC < .15

You will be charged with a second offense DUI if it is within 7 years from the date of your first DUI conviction.

Jail Time: The minimum is 90 days in jail with the possibility of 60 being suspended if you complete a drug/alcohol assessment and classes. You may be eligible for home detention after the first 15 days depending on the court you are in.

Work Release: You may be eligible to be released for work up to 5 days per week at no more than 12 hours per day.

Fines & Costs: Minimum $250 fine plus 80% surcharge, $1,250 prison assessment fee, $250 abatement fee, jail costs, treatment costs, probation fees (you may be placed on probation up to 5 years).

License Implications: Your license will be revoked for 1 year. You are not eligible for a work permit and your license is not automatically reinstated.

Ignition Interlock Device: Yes. For 1 year after your license is reinstated.

Community Service: The court must impose a minimum of 30 hours of community service.

Second Offense Extreme DUI (BAC .150 – .199)

Jail Time: You must serve a minimum of 120 days in jail with the possibility of having 60 days suspended.

Work Release: You may be eligible to be released for work up to 5 days per week at no more than 12 hours per day.

Fines & Costs: Minimum $500 fine plus 80% surcharge, $1,250 prison assessment fee, $1,250 DPS fee, $250 abatement fee, jail costs, treatment costs, probation fees (you may be placed on probation up to 5 years).

License Implications: Your license will be revoked for 1 year. You are not eligible for a work permit and your license is not automatically reinstated.

Second Offense “Super Extreme ” DUI (BAC .200 or higher)

Jail Time: You will be sentenced to 180 days of jail. 90 days must be served consecutively and the remaining 90 can be served on a non-consecutive basis.

Work Release: You may be eligible to be released for work up to 5 days per week at no more than 12 hours per day.

Fines & Costs: Fines can total up to $4,000 plus jail costs which can add up to an additional $18,000Minimum $500 fine plus 80% surcharge, $1,250 prison assessment fee, $1,250 DPS fee, $250 abatement fee, jail costs, treatment costs, probation fees (you may be placed on probation up to 5 years).

License Implications: Your license will be revoked for 1 year. You are not eligible for a work permit and your license is not automatically reinstated.
